Newsflash

 

Gov. Tomblin has finally signed the Puppy Mill Bill!   Five long years for this bill and the Spay Neuter Bill to get through the Legislature.   Both have been tweaked but they still passed.   We will provide more of an update on exactly what each bill means for the animals of WV soon.   For now, let's just enjoy our measure of success!   Thanks to all of you who made calls, sent emails and went to Charleston.  You truly were the voice for these animals!

YOU DID IT!!!!!!!

The 2013 WV Legislative Session is over and 3 animal bills passed!   SB 202, the spay neuter assistance bill has been signed.  HB 2399 livestock in dire conditions was signed.   Finall,y the Puppy Mill Bill, SB 437 has been signed.  

Sylvia Shafer, of FOHO WV Legislative Action is posting comments daily or as often as something occurs with animal legislation.  This enables you to follow the progress of this very important legislation.   Please check here daily for what is occurring with animal legislation and how you can help be the voice for animal throughout West Virginia.  Please follow our ‘call to action’ when needed to contact your representatives.   Please be the voice for these animals in WV.   We are told time and again from our legislators that they do not hear from the animal welfare people like they do the environmentalists, the hunters and other interest groups. Let's make our voices heard for the animals.

FOHO WVLA note*   Our sincere thanks to the WV Legislature for the passage of these bills!!   3 animal bills have passed.   Please let your legislators know that you appreciate their recognition of these issues and that they have taken the steps to help by passing this legislation.  We will discuss this legislation in more depth soon.  Both the Puppy Mill Bill and the Spay Neuter Funding Assistance Bill have taken 5 years to pass and only thanks to the emails and calls from animal advocates throughout the state have we finally had success.

SB202 Spay/Neuter was signed on 5-1 with the effective date of 7-12-2013. This law establishes a fund for s/n but the rules must be established and approved by the legislature. This means there will not be any money available until the next session in 2014.   I know this is disappointing but we now have an account established with the state.  This program will work through the Dept. of Agriculture.

 SB 437 the puppy mill bill was signed 5-3 with an effective date of 7-11-2013. This bill involves the County Commission, Law enforcement and Humane Officers. If you are involved with animal control and humane officers, please alert your County Commission of  this law.  

 HB 2399 Livestock in dire condition was signed into law on 4-29 with and effective date of 7-12-13. This law involves the County Commission and humane officers. If  you are involved with humane officers, animal control, or law enforcement, please alert your County Commission of this law.

 Be sure to copy the final version of these laws.

My thanks to everyone who has helped with the passage of  these bills. The S/N and the Puppy Mill bill passed on the fifth year attempt.  This could have never happened without your help. Don’t forget to thank the legislators who have helped and Governor Tomlin for signing them into law.  The Puppy Mill bill had great opposition from AKC and breeders and Gov. SB 202 Spay Neuter Bill and HB 2399 Livestock in dire conditions and SB 437, the Puppy Mill Bill have all passed this session!  It has been a productive session for animal welfare.  Thanks to all of you who kept the phone calls and emails flowing to your legislators.  It made a difference.   Also thanks to ASPCA and to HSUS and Summer Wyatt for their lobbying effort for this legislation.   And as always thanks to our own special Sylvia Shafer who walks those halls almost daily talking to legislators about animal legislation and keeping us informed on its progress.   Our voices were strong for the animals this year!

All animal bills are dead except the three listed below. The following bills passed today. REP. stands for Republican

 

SB 202 Spay/neuter passed the House with five NAY votes from Troy Andres (REP. Putnam Co.), Anna Border Shepherd (REP. Wood Co.), Michael Folk (REP. Berkeley Co.), Bill Hamilton (REP Upshur Co.), Eric Householder (REP Berkeley Co.)  This bill now must go back to the Senate for them to concur on a minor amendment.

HB 2399 Livestock in Dire Conditions passed the Senate today with all members voting yes. This bill must now go back to the House for them to concur on an amendment.

SB 437 The puppy mill bill passed today with 66 yeas and 33 nays. R will stand for republican and D for Democrat. I am listing the NAYS

AAWV expresses need for puppy mill bill! PDF Print E-mail

FOHO WVLA felt that Animal Advocates of West Virginia summarized our need in WV for a Commercial Breeding Bill or Puppy Mill Bill so well that we asked permission to reprint their letter to legislators plus an article that was in the Martinsburg Journal in February.    They have also provided a case against the AKC, one which FOHO WV is increasingly supporting.  Especially since they (AKC) sent letters to Senators against SB 437 the puppy mill bill to kill it in this 2013 session.  It did however pass the Senate anyway.  Now we need to contact our house members.   It seems that many animal advocates around the country are finding out more about the AKC and not liking what the AKC has become.  This notion is supported in this recent NY Times article on the AKC showing how increasing awareness of the AKC's push to thwart animal welfare legislation, including some accounts of facilities that the AKC inspected and cleared and then shortly afterwords were shut down by local authorities due to poor conditions.  read this now .....NY Times article

Dear animal advocate,

Please send a brief message to (your house members) asking them to support current Senate Bill 437 Commercial Breeder Bill (anti-puppy mill bill). Please inform them that the American Kennel Club is and has been one of the strongest opponents of the bill due to the AKC losing over 50% of dog and puppy registrations in 2008. The AKC board of directors then made a decision to "go after" commercial breeders in order to increase AKC puppy registrations therefore putting more money back in the pockets of the AKC. The AKC supports puppy mills/commercial breeding because it makes them wealthier through increased registrations. Not one penny of the registration money stays in West Virginia but goes directly to the AKC offices in North Carolina and Madison Avenue in NYC. Below is a letter that I wrote and had published in The Martinsburg Journal and you are welcome to use parts of the letter to help you construct your own message. Thank you for helping to keep this bill alive and informing your legislators concerning the real reason that the AKC does not want to see this bill passed.

Here is the  letter which was submitted to the Martinsburg Journal in support of the Puppy Mill Bill. 

The Martinsburg Journal Letter to the Editor February 19, 2013 

Better puppy protection needed throughout W.Va 

A puppy mill bill will be introduced to our WV legislators (for a fifth time) asking for measures to be set into law that will ensure humane treatment of breeding dogs as well as their off-spring in commercial breeding operations. Even though West Virginia has animal cruelty laws, the breeding operations aren't inspected and are exposed only if someone complains to authorities. Whether the breeding operation is large or small, the suffering and squalor is all the same.  

After contacting local legislators I found that the American Kennel Club is contacting our legislators asking that our puppy mill bill not be passed. In the AKC's 2008 annual report, Ron Menaker, CEO of the AKC, made the following statements:  

“The American Kennel Club faces enormous challenges in reversing the continuing decline in registrations. Today, we are losing market share at an alarming rate, especially in the retail sector. We are being challenged competitively and financially. The declining registrations and associated core revenues, if allowed to continue, will fundamentally change our organization going forward. Make no mistake, the very future of the AKC and our sport is at risk. Management has been directed by the Board to aggressively pursue all dogs eligible for AKC registration. We intend to reach out, communicate, and educate those in the retail sector as to why an AKC puppy is the gold standard and why they should be registered with American Kennel Club.

Why we need spay neuter funding! PDF Print E-mail

A projected 144,000 animals were taken into WV shelters in 2011 and approximately 77,000 were euthanized.    We estimate more than 54% of all animals entering our shelters in WV are killed.  Most are healthy, adoptable animals that are needlessly dying.  39% of the dogs are killed and 71% of the cats.  It also takes about $8 million per year to impound, care for and kill those unwanted animals in WV.  It is approximately $56 per animal handled as a cost to the taxpayers of WV.  FOHO WV has been surveying WV Animal Shelters on intake and euthanasia since 2008.  In 2008, we had a cross section of 12 shelters from different areas of the state that provided good statistics.  In 2009, a WVU student in cooperation with FOHO WV surveyed all 55 counties, some of which do not have a facility, animal control or statistics were not kept.  20 of 55 counties reported no data kept so we know the numbers are much higher than this.  In 2011, the WV Veterinary Board  required a report of the 30 counties with CAETs and their euthanasia rates for those counties.    By 2013 at the request of FOHO, they will also request intake numbers on their reports.   There is no central reporting agency in WV to gather these statistics like in other states.  There is also no mandate in WV for shelters to take cats and when they do accept cats, those euthanasia rates were very high.    We have collected 2010 and 2011 statistics .  Spay neuter is a critical missing ingredient.  We need legislation to be passed providing needed funding to reverse this trend.    FOHO WVLA was invited to attend the Senate Interim Committee meeting on the question of spay neuter on Sept 10th. and again in October.  We will keep you informed of what legislation will arise out of these meetings.  There are 3 Pet Food Industry lobbiest in Charleston working diligently against us.    There are a lot of animal lovers in WV.  Our legislators need to hear from them!

Zero tolerance for breed specific bans PDF Print E-mail

Bluefield WV – City officials are again threatening dog owners with a ban on specific types of dogs.   In 2008 officials enacted regulations for owning pit bulldogs and wolf-hybrids. These regulations included a 6-sided kennel to be locked with key or combination lock, muzzling and maximum 6 ft. leashing when the dog was outside of the kennel, and stringent guidelines for keeping the dog inside the home including no open windows or screened windows if the dog was loose in the house.

Because city officials refuse to admit this is an enforcement issue, they have instead initiated a ‘zero tolerance’ policy claiming it is a compliance issue. Yet, the local law passed without public notification, and communication of the law since 2008 has been minimal in notifying the community of the requirements.

Community members ask “How are we to comply if we are unaware and the law is not being enforced across the board?”

A good question and one for which the public deserves an answer.  But instead, officials chose to take a different route; they would prefer to simply ban any dog the animal control officer and municipal judge believes might be a pit bulldog or wolf-hybrid.

On April 2nd, FOHO WV Legislative member,  Jo Staats, met with members of the Bluefield community that have opposed further breed specific legislation. The Bluefield Responsible Dog Owner’s Coalition is taking measures to not only ensure further actions are taken that punish good dogs and responsible owners, but to work for repeal of the current BSL regulations. They want to see a breed free ordinance that will provide animal control the ability to enforce the law, protect dogs that have not acted aggressively and will promote community safety by ensuring any dog that is vicious is controlled. Jo Staats, a longtime advocate for pit bull type dogs, will be working with the Coalition in developing a grassroots campaign to increase public awareness of the actions of the city officials, she is also providing legal counsel to any qualified plaintiff should civil recourse become necessary in thwarting BSL in the area. Staats said, “Our intent is to negotiate reasonable and effective legislation with the City Board of Directors.  However, we want owners to know they are not in this alone and the state and nation is watching, preparing to provide assistance however it may be needed.”

FOHO WV’s position on Breed Specific Legislation is a ‘zero tolerance’. We do not support legislation that targets dogs based on their appearance.

While we, as an organization, have worked to accomplish animal laws on a state level we also work with local communities in an effort to ensure animals as well as human-counterparts are protected from abuse and neglect.  FOHO WV Legislation Action is preparing for the 2014 Legislative Session already working on a state level Dangerous Dog Bill that will provide communities, statewide with both human and canine protection.
